Avery Ranch homeowner Fred Yazdi will go to court Monday and is expected to plea not guilty in the controversial shooting of 23-year-old Enrico Recio.
Yazdi shot Recio three times on February 3 in front of his home on Staked Planes Drive. Yazdi claims he was threatened after finding Recio in his driveway hiding underneath his wife’s car at 3 a.m.
Recio had crashed his car on nearby Avery Ranch Boulevard and fled the scene. Yazdi says he came outside his home, confronted Recio, and told him not to move or he would shoot him. Recio’s body was found 100 feet from Yazdi’s property. That prompted Austin police to arrest Yazdi and charge him with murder.
The case will ultimately be put to a Grand Jury. Yazdi is expected to argue the Texas Castle Doctrine. The law allows a person to use deadly force when confronted by another person who unlawfully or forcefully enters or attempts to enter the victim’s place of residence, vehicle, or place of employment.
